Frequently Asked Questions: Old Regime Deduction Requirements

Clear answers to common questions on CTC structure, take-home calculations, Budget 2024 tax slabs, and Section 87A rebate rules.

What is the single biggest factor in deciding between New and Old Tax Regime?

The single biggest factor is House Rent Allowance (HRA) exemption or Section 24 Home Loan Interest. Because Section 80C is strictly capped at ₹1.5 Lakhs, Section 80CCD(1B) NPS is capped at ₹50,000, and Section 80D is capped at ₹25k–₹75k, you cannot bridge the ~₹4.00 Lakhs breakeven gap without significant rent payments (₹20,000+/month) or home loan interest.

Can I choose New Regime with employer and switch to Old Regime during ITR filing?

Yes, absolutely. Salaried individuals can freely switch between the New Tax Regime and Old Tax Regime when filing their annual return of income under Section 139(1), regardless of what investment declaration was submitted to company HR during the year.

Does employer NPS contribution count towards the Old Regime breakeven?

No, because Employer NPS contribution under Section 80CCD(2) is allowed in BOTH the New and Old Tax Regimes up to 14% of Basic Salary + DA. Because it reduces taxable income equally in both regimes, it does not help the Old Regime overcome the New Regime's rate advantage.
